Terms and Conditions

These Terms and Conditions (“Terms”) govern access to the Forttic website and general use of services offered by Forttic Inc. (“Forttic,” “we,” “us,” or “our”). If your organization executes a separate Master Services Agreement, Order Form, or Statement of Work with Forttic, that agreement controls to the extent of any conflict with these Terms for paid subscription services.

1. Acceptance

By accessing forttic.com, registering for an account, booking a briefing, submitting an assessment request, or using the Forttic platform (the “Services”), you agree to these Terms and our Privacy Policy. If you accept on behalf of an organization, you represent that you have authority to bind that organization. If you do not agree, do not use the Services.

2. Eligibility and business use

The Services are intended for business and professional use. You must be at least 18 years old and capable of forming a binding contract. You may not use the Services if you are barred under applicable law or if Forttic has suspended or terminated your access.

3. Description of services

Forttic provides a Continuous Resilience Enforcement platform that helps organizations discover backup and cloud resilience posture, enforce policies (including the 3-2-1-1-0 framework), verify recovery readiness, and generate evidence for operational, insurance, and regulatory purposes. Features may include integrations with backup vendors and cloud providers, automated assessments, reporting, and agentic capabilities such as “Ask Forttic.” Features vary by subscription tier and may change over time.

4. Accounts and registration

You must provide accurate registration information and keep it current. You are responsible for safeguarding credentials and for all activity under your account. Notify us promptly at hello@forttic.com of any unauthorized use.

5. Customer data and integrations

Your data. You retain ownership of data you submit or connect to the Services (“Customer Data”), including metadata from authorized integrations. You grant Forttic a limited license to host, process, and display Customer Data solely to provide and improve the Services, as described in our Privacy Policy and any applicable DPA.

Your responsibilities. You represent that you have all rights and permissions necessary to connect third-party systems and to provide Customer Data to Forttic. You are responsible for configuring integrations, reviewing enforcement actions, and maintaining appropriate internal approvals before automated or agentic actions affect production environments.

No guarantee of outcomes. Forttic helps identify gaps, enforce configured standards, and produce evidence artifacts. We do not guarantee uninterrupted backups, successful recovery in every scenario, insurance claim approval, or regulatory compliance — those outcomes depend on your environment, configuration, and applicable requirements.

6. Acceptable use

You agree not to:

  • Use the Services in violation of law, regulation, or third-party rights;
  • Access systems or data without authorization;
  • Reverse engineer, decompile, or attempt to extract source code except where permitted by law;
  • Interfere with or disrupt the integrity or performance of the Services;
  • Probe, scan, or test vulnerabilities without Forttic’s prior written consent;
  • Use the Services to build a competing product using non-public aspects of the platform;
  • Transmit malware, spam, or abusive content;
  • Misrepresent your identity or affiliation.

We may suspend or terminate access for conduct that violates these Terms or creates risk to Forttic or other customers.

7. AI and Ask Forttic

Certain features use automated and agentic systems to interpret resilience data and respond to natural-language queries. Outputs are provided for informational and operational assistance only. You are responsible for reviewing outputs before relying on them for recovery decisions, regulatory submissions, insurance representations, or executive reporting. AI-generated content may be incomplete or inaccurate; human judgment remains required.

8. Intellectual property

Forttic and its licensors own the Services, software, documentation, trademarks, and all related intellectual property, excluding Customer Data. No rights are granted except as expressly stated. You may not use Forttic’s name, logo, or marks without prior written consent, except as permitted for factual reference to your use of the Services.

9. Confidentiality

Each party may receive non-public information from the other. The receiving party will use reasonable care to protect confidential information and use it only for purposes related to the Services. This obligation does not apply to information that is public, independently developed, or rightfully received from a third party without restriction.

10. Free evaluations, assessments, and briefings

Forttic may offer free assessments, briefings, trials, or beta features at its discretion. Such offerings are provided “as available,” may be modified or discontinued at any time, and may have usage limits. Beta features may be less reliable and are provided for evaluation purposes.

11. Fees and paid subscriptions

Paid subscriptions are governed by the applicable Order Form or agreement, including fees, term, renewal, and payment terms. Unless otherwise stated, fees are non-refundable. Failure to pay may result in suspension or termination of access.

12. Disclaimers

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICES AND WEBSITE ARE PROVIDED “AS IS” AND “AS AVAILABLE.” FORTTIC DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. FORTTIC DOES NOT WARRANT THAT THE SERVICES WILL BE ERROR-FREE, UNINTERRUPTED, OR THAT DEFECTS WILL BE CORRECTED.

Reference materials on the website (including blog content, framework guides, and statistics) are for general information only and do not constitute legal, insurance, or compliance advice.

13. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FORTTIC AND ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AND SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS INTERRUPTION, ARISING FROM OR RELATED TO THESE TERMS OR THE SERVICES, EVEN IF ADVISED OF THE POSSIBILITY.

FORTTIC’S TOTAL LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICES IN ANY TWELVE-MONTH PERIOD WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS PAID BY YOU TO FORTTIC FOR THE SERVICES IN THAT PERIOD OR (B) ONE HUNDRED U.S. DOLLARS (US$100) FOR FREE OR EVALUATION USE.

Some jurisdictions do not allow certain limitations; in those cases, our liability is limited to the fullest extent permitted by law.

14. Indemnification

You will defend, indemnify, and hold harmless Forttic and its affiliates, officers, directors, employees, and agents from claims, damages, losses, and expenses (including reasonable legal fees) arising from your Customer Data, your use of the Services, your integrations, violation of these Terms, or violation of applicable law — except to the extent caused by Forttic’s gross negligence or willful misconduct.

15. Term and termination

These Terms remain in effect while you use the Services. You may stop using the Services at any time. Forttic may suspend or terminate access for breach, risk, non-payment, or discontinuation of the Services. Upon termination, your right to access the Services ends. Provisions that by nature should survive (including intellectual property, disclaimers, limitation of liability, indemnification, and governing law) will survive.

16. Governing law and disputes

These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict-of-laws principles. The exclusive jurisdiction for disputes arising from these Terms or the website shall be the state and federal courts located in Delaware, and each party consents to personal jurisdiction there — except that either party may seek injunctive relief in any court of competent jurisdiction to protect intellectual property or confidential information.

Before filing a claim, you agree to contact us at hello@forttic.com and attempt to resolve the dispute informally for at least thirty (30) days.

17. Export compliance

You may not use or export the Services except as authorized by U.S. law and applicable export control regulations. You represent that you are not located in, or ordinarily resident in, a country subject to comprehensive U.S. embargo or designated as a terrorist-supporting country, and are not on any U.S. government restricted-party list.

18. General

  • Changes. We may modify these Terms by posting an updated version. Material changes will be indicated by updating the effective date. Continued use after changes constitutes acceptance.
  • Assignment. You may not assign these Terms without Forttic’s consent. Forttic may assign these Terms in connection with a merger or sale of assets.
  • Severability. If any provision is unenforceable, the remainder stays in effect.
  • Entire agreement. These Terms and the Privacy Policy constitute the entire agreement regarding website and general service use, except where superseded by a signed enterprise agreement.
  • Force majeure. Forttic is not liable for delays or failures due to events beyond reasonable control.
